The Fruit and Vegetable Dispute Organization (the DRC) recently announced it will celebrate its 25th anniversary in 2025, as well as a the expansion of its jurisdiction. In June 2024, at the DRC Board of Directors (BoD) meeting The BoD accepted amendments to the DRC operating regulations to remove the requirement that disputes concern items that enter commerce from Canada, Mexico, or the United States.
Before the amendments, members were only able to file an Notice of Dispute (NOD) in order to begin the informal mediation process when one of the parties was located in Canada, Mexico, or the United States. As an example in the event that the DRC member from Chile faced a conflict with a member within Asia or Europe The organization will not be able accept the NOD.
The DRC’s board has approved modifications of its operating regulations to remove the condition that disputes must concern products that are sold in Canada, Mexico, or the United States.
The extension of jurisdiction allows the DRC’s Dispute Resolution Rules, including informal mediation, formal mediation as well as arbitration services, to operate without limitations on jurisdiction. It is applicable as long as the parties belong to the DRC when the dispute occurs. the dispute and the agreement contains an arbitration clause in the DRC arbitration clause or both parties are willing to sign an arbitration agreement that resolves disputes through DRC.
In the midst of celebrating the 25th anniversary of training, mediation as well as arbitration. This upgrade will not change the way its members conduct business. rather, it broadens access to dispute resolution options, which allows its members to trade confidently anyplace in the world.
